EXPANDED REGIONAL POSTCODES IN AND AROUND BRISBANE
Whilst a lot of focus has been on the recent amendments to the 186 transition program what is probably just as significant is the inclusion of many more Brisbane areas in the definition of Designated Regional area.
Postcodes 4019 to 4022, 4025, 4037, 4074, 4076 to 4078, 4300 to 4301, 4303 to 4305, 4500 to 4506, 4508 to 4512, 4514 to 4516 and 4521 have been included.
Clontarf, Margate, Woody Point, Redcliffe, Scarborough, Newport, Kipparing, Rothwell, Bulwer, Cape Moreton, Cowan Cowan, Kooringal and Tangalooma, Eatons Hill, Jindalee, Middle Park, River Hills, Darra, Waco, Inala, Richlands, Durack, Brisbane, Doolandella, Forrest lake, Ellen Grove, Augustine Heights (QLD), Bellbird Park, Brookwater, Camira, Carole Park, Gailes, Goodna, Springfield, Springfield Central, Springfield Lakes, Collingwood Park, Redbank, Dinmore, New Chum, Riverview, Booval, Bundamba, Silkstone, North Booval, Brisbane, Blackstone, Ebbw Vale, Ipswich, Brassall, Raceview, North Ipswich, Strathpine, Brendale, Warner, Bray Park, Cashmere, Joyner, Clear Mountain, Lawton, Petrie, Kallangur, Murrumba Downs, Griffin, Dakabin, Kurwongbah, Whiteside, Narangba, Burpengary, Burpengary East, Morayfield, Moorina, Deception Bay, North Lakes, Mango Hill, Caboolture, Caboolture South, Beachmere, Bellmere, Ningi, Sandstone Point, Godwin Beach, Wamuran, Wamuran Basin, Bracalba, Woodford, Delaneys Creek, D'Aguilar, Stanmore, Villeneuve, Kilcoy, Sandy Creek, Hazeldean, Woolmar, Mount Kilcoy, Dayboro, Ocean View, Mount Mee, Laceys Creek, Mount Pleasant, King Scrub, Rush Creek and Campbells Pocket. This is not an exhaustive list but you can see there has been a significant increase in and around the Brisbane area of Designated Regional areas.
This means that workers in these areas can now access temporary 491 and 494 visas with permanent residency eventually through a 191.
186 TRANSITION PROGRAM UPDATE
On 18 March 2022, the Department implemented changes to the transition pathway. From 1 July 2022, existing TSS (484) visa holders in the short-term stream will be able to apply for permanent residence through the Temporary Residence Transition (TRT) stream of the Subclass 186 Employer Nomination Scheme (ENS) visa. To be eligible to apply as a short-term stream TSS visa holder, applicants must have been in Australia between 1 February 2020 and 14 December 2021 for at least one year. Applicants must meet all other nomination and visa requirements for the TRT stream of the ENS visa. The pathway will be accessible for two years from its commencement on 1 July 2022.
Given the expiry date of the pathway being two years after implementation, applicants who do not already hold a 482 for at least 12 months (as of 1 July 2022) will not be able to transition to the 186 if in the short term stream.
THIRD SHORT TERM 482 VISA AVAILABLE
From 1 July 2022 holders of short term 482 visas are able to make a third visa application onshore to allow for extra time to qualify for the transition to a 186 visa.
Requirements to be met include:
- Being in Australia for 12 months between 1 February 2020 to 14 December 2021; and
- Third Visa application must be made prior to 1 July 2023.
If you short term 482 expires after 1 July 2023 we would recommend applying for the third visa prior to this date.
CLAIMING SPOUSE POINTS ON YOUR EOI.
When calculating points in your expression of interest the SkillSelect system will allocate points for partner relationship status as follows;
Single – SkillSelect will award 10 points Engaged – SkillSelect will award 10 points Married – SkillSelect will award 0 points De Facto – SkillSelect will award 0 points
Applicant's marital status will sometimes change between lodging the EOI, lodging the visa application, and when a decision is made on points. This change of status may result in the loss or gain of points at visa assessment. For example, a person assigned 10 points (as single) at EOI, may lose these 10 points at the visa application stage if they have subsequently married or entered a de facto relationship.
Where intending applicants are both in a de facto relationship and engaged simultaneously at time of EOI, they may consider selecting “De Facto” rather than “Engaged” when calculating their point score irrespective of the length of the de facto relationship. This will avoid being invited at a higher point score than what the visa applicant will be able to meet.
The above does not apply to points being claimed where points are being claimed for partners with the necessary skills and English language level etc.
